Nikah is the Islamic marriage contract between a bride and groom. It is made verbally and in writing through mutual consent of both bride and groom. The Nikah contract is vital in Islam and outlines the responsibilities and rights of both the bride and groom. Although Nikah’s ceremony takes place in the physical presence of both the bride and groom, some circumstances can lead to Nikah’s online presence.

Online Nikah may also be referred to as proxy marriage. It takes place when either the bride or groom is not physically present at the same time and the same place. The Nikah takes place either through online video call or at sometimes, or in some cases, through a phone call. The ceremony at both sides occurs in the presence of the marriage registrar, also known as the Nikah Khawan.

It is a unique opportunity that exists in both the Shariah and Marriage Law in Pakistan. It is mostly fit for overseas Pakistanis living abroad that, for some reason, cannot physically participate in their marriage.

Shariah Requirements of Nikah

Since Nikah is an Islamic Marriage contract, it is performed after fulfilling the following requirements of Shariah:

  • A Man as the groom and a woman as a bride
  • Both should be Na-Mehram
  • Both should be adults
  • Both should have mutual consent
  • Two witnesses should be available
  • Both parties should agree upon the Dower amount or Haq-e-Mehr

Documents required for online Nikah

  • Proof of identity of the bride, I.e., a copy of CNIC or a copy of Passport
  • Proof of identity of the groom, I.e., a copy of CNIC or a copy of Passport
  • Six passports sized photographs
  • Proof of identity of the two witnesses, I.e., a copy of CNIC or a copy of Passport
  • Letter of appointment of lawyer/permission letter
  • In case its grooms’ second marriage, a permission letter for second marriage is required
  • The bride’s second marriage, the divorce certificate or the first husband’s death certificate, is required

The procedure of online Nikah

  • You have required to email the particulars of the marriage form along with the copies of CNIC/Passport to the online lawyer
  • The lawyer chooses a convenient date and time for the Nikah ceremony on which both parties can appear on video conference
  • On the scheduled date and time, in the presence of both parties online, the Nikah Khawan recites Khutba-e-Nikah and witnesses Ejab-o-Qabool in the presence of the lawyer and witnesses.
  • After the administration of Nikah, all legal parties sign the Nikah Nama, and the lawyer seals the document with his seal, and thus the procedure is complete.
  • Two witnesses should be available
  • Both parties should agree upon the Dower amount or Haq-e-Mehr
